1. Who is responsible for what?
Each week the HOA office receives many calls wanting to know if the HOA is responsible for a specific area. Here is a brief rundown of some of the more common questions.
Amenity and Common Areas: These areas are owned and maintained by the Legacy Park HOA. The dues paid by each homeowner contribute to the upkeep of these areas: The main Legacy Park entrance, the area along Legacy Park Boulevard, Lake Legacy, the area along Legacy Park Circle, the neighborhood entrances and monuments, Town Green, neighborhood playgrounds, Town Club, Pools, Pump Houses, Amphitheater, Tennis Courts, Basketball Court, Volleyball Court, Baseball field, Walking Trails, Bridges, Picnic Grove and the Bandstand. To report a problem in one of these areas contact the HOA office at 770-919-2556.
Streets & Sidewalks: All of the streets within Legacy Park are owned and maintained by the City of Kennesaw. The KCPD has the right to ticket and/or tow any car illegally parked on the street or sidewalk. The non-emergency number for the KCPD is 770-422-2505.
Street Lights: The ornamental streetlights and the lights at the common areas are owned and maintained by the HOA. To report an outage, contact the HOA at 770-919-2556. The “cobra head” streetlights are owned and maintained by Georgia Power or Cobb EMC depending on who provides the power in the area. To report a light problem contact GA Power at 888-655-5888 or Cobb EMC at 770-249-2100.
Trees along neighborhood streets: The homeowner is the owner of the trees that are planted in the neighborhoods between the street and the sidewalk. It is the responsibility of the individual homeowner to prune these trees on a regular basis. The city recommends that you remove any branches growing at a height lower than 6 feet.
Power Lines: Georgia Power owns the high voltage power lines that run through Legacy Park. Georgia Power is responsible for cutting the grass and maintaining the land that the lines are located on. If these areas are in need of attention contact GA Power at 404-817-3079.
Storm Water Drainage Areas: These areas that run between neighborhoods, and at the back of homeowner’s lots are generally owned by the individual homeowner. Each homeowner should refer to the plat of their property for further clarification. However, if a major drainage problem exists with the drain itself the homeowner should contact Cobb County Water & Sewer, 770-423-1000, as they are responsible for correcting any problems. The homeowner is required to make this call as they will have to allow Cobb County access to their property.

Kennesaw City Code Sec. 22-120. REQUIREMENTS OF SOLICITORS.
Soliciting or canvassing upon the public streets, areas or parks, or calling from house to house in the city shall be subject to the following regulations:

All soliciting or canvassing upon the public streets, areas or parks or calling from house to house in the city shall only occur between the hours of 9:00 a.m. and 6:00 p.m.

The number of solicitors or canvassers or callers from house to house in the city for any single firm, corporation or organization shall not exceed 25 in number at any one time.

Immediately prior to any solicitation of funds within the city, each solicitor, canvasser or caller shall present his identity card, issued by the business license department, to each person solicited.
Kennesaw City Code Sec. 22-121. PROHIBITED ACTS, SOLICITOR.
It shall be unlawful for any solicitor, canvasser or caller to do any of the following:

Falsely represent, directly or by implication, that funds are being solicited on behalf of any person or organization other than as registered with the business license department.

Without the express prior permission of an occupant or property owner, solicit at any residence, address, apartment complex or shopping mall where there is posted a sign forbidding any solicitation, other than areas open to public parking.

Remain on private premises after being asked to leave the premises or continue solicitation after being refused upon the public streets, areas or parks; such action shall constitute trespass or harassment, respectively.
Kennesaw City Code Sec. 74-35. SWEEPING OR THROWING TRASH ON STREETS AND SIDEWALKS; DISTRIBUTING HANDBILLS.
(a) It shall be unlawful and constitute disorderly conduct for any merchant, his agent, employee, or representative, or for any other person, to sweep, throw, place, scatter, or cause to be swept, thrown, placed, or scattered, any paper, paper wrappings, cardboard boxes, sweepings, rubbish, or debris such as is commonly and generally collected and hauled away by the city sanitary trucks to the garbage grounds, into, in, on or upon the streets, sidewalks, public alleys, or public parks of the city unless there enumerated matters and things are placed in adequate containers, conveniently located, for the department of public works personnel to reach and collect for the purpose of disposing of such items in regular routine operations of the department of public works. It shall be unlawful and disorderly conduct for any person, singly or collectively, to sweep, throw, place or cause to be placed, located, or put in a position or place any of the matters or things enumerated in this section, which such matters and things will normally and naturally be blown, scattered, or carried by ordinary and usual winds or rains into, in or upon any of the streets, sidewalks, parks, public alleys, or upon the private property of others as scattered, untidy, unsightly, or unsanitary litter, rubbish, or debris.
(b) It shall be unlawful and constitute littering for any person to hand out, distribute or leave in any public parking area of the city, or in or on any motor vehicle therein, any handbill, flyer, brochure, announcement, advertisement or other document advertising, promoting or offering to sell or rent any product, good, ware, merchandise or services unless such handbill, flyer, brochure, announcement, advertisement or other document is personally and directly handed to another individual.
Kennesaw City Code Sec. 74-108. UNLAWFUL ACTIVITIES.
It shall be unlawful for any person to dump, deposit, place, throw or leave, or to cause or permit the dumping, depositing, placing, throwing or leaving of litter on any public or private property in the city, unless:

Such property is designated by the city for the disposal of such litter, and such person is authorized by the proper public authority to use such property;

Such litter is placed into a closed litter receptacle or container installed on such property;
-
Such person is the owner or tenant in lawful possession of such property, or has first obtained consent of the owner or tenant in lawful possession, or unless the act is done under the personal direction of the owner or tenant, all in a manner so that such litter may not be scattered or carried by wind or water.
Kennesaw City Code Sec. 62-4. CURFEW FOR MINORS.
(a) It shall be unlawful for any person 17 years of age or younger to idle, loiter or congregate with any other persons on or in the public streets, sidewalks or other public places within the city between the hours of 12:00 p.m. and 5:00 a.m. Provided, that the provisions of this section shall not apply to minor accompanied by his parent, legal guardian or other adult person having legal care and custody of the minor or where the minor is on an emergency errand or legitimate business, such at, but not limited to, returning home from work or from school sponsored activities, and directed by his parent or other adult person having the legal care and custody of the minor.
(b) It shall be unlawful for any parent, guardian or other person having custody or control of any minor 17 years of age or younger to permit, allow or encourage such minor to violate this section.
Kennesaw City Code Sec. 46-31. DECLARATION OF NUISANCE CONDITIONS.
The following conditions may be declared to be nuisances:

Stagnant water on premises;
-
Any dead or decaying matter, weeds, vegetation or any fruit, vegetable, animal or rodent, upon premises which is odorous or capable of causing disease or annoyance to the inhabitants of the city;

The generation of smoke or fumes in sufficient amount to cause odor or annoyance to the inhabitants of the city;
-
The pollution of public water or the injection of matter into the sewage system which would be damaging thereto;
-
Maintaining a dangerous or diseased animal or fowl;
-
Obstruction of a public street, highway or sidewalk without a permit;
-
Loud or unusual noises which are detrimental or annoying to the public, including without limitation, unusual or loud disturbances in or around churches or multiple-family complexes such as loud music and other activities in swimming pool and clubhouse areas;
-
All walls, trees and buildings that may endanger persons or property;
-
Any business or building where illegal activities are habitually and commonly conducted in such a manner as to reasonably suggest that the owner or operator of the business or building was aware of the illegal activities and failed to reasonably attempt to prevent those activities;
-
Unused iceboxes, refrigerators and the like unless the doors, latches or locks thereof are removed;
-
Any trees, shrubbery or other plants or parts thereof, which obstruct clear, safe vision on roadways and intersections of the city; and
-
Any other condition constituting a nuisance under state law.
Kennesaw City Code Sec. 14-4. NOISY OR OFFENSIVE ANIMAL.
It shall be unlawful for any person to keep, maintain or permit any dog or other animal in the city in such a manner that such dog or other animal becomes unreasonably noisy or offensive to the neighbors or citizens of the city, or disturbs the general peace of the city.
Kennesaw City Code Sec. 66-9. ANIMALS PROHIBITED.
It shall be unlawful for any person who harbors, possesses or is in charge of a domestic restrained or unrestrained animal, such as dogs, cats, etc., to bring such animal onto athletic fields or in city parks.
Kennesaw City Code Sec. 14-28. DOGS - DUTY TO CONTROL.

It shall be unlawful for the owner of any dog to permit such dog to be out of control and unattended off the premises of the owner in the city, or upon the property of another person without the permission of the owner or person in possession of such other property.

It shall be the duty of any owner or any person having charge, possession, or control of any dog to immediately clean up any feces left by such dog on any public street, sidewalk, park land or other public area, or any private property not owned by the owner of such dog.
